Disciplinary action against doctors

This is why doctors need:

  1. Their own defence body cover - employer's cover will not protect the doctor in a dispute between them and their employer; and an employer may decide to settle out of court or not to dispute an action if they judge the financial risk to be greater than defending a member of staff.
  2. Trade union membership.

The defence society role is the legal/forensic one. The trade union one is to assist people with the process. The National Clinical Assessment Service (NCAS) may also have a role.

The Court of Appeal has held that a doctor should be allowed to be accompanied by a lawyer at a disciplinary hearing in circumstances where he or she is facing charges that are of such gravity that, in the event they are proven, he or she will effectively be barred from employment in the NHS.[1][2]
