The Act of Parliament which provides most of the powers of the secretary of state for health, his department and the NHS administration.

Section 60

This section reified the Secretary of State's power to order the release of patient identifiable information for research purposes. It does not (on the opinion of BMA/GPC lawyers) extend to other purposes, for instance monitoring the delivery of service to Diabetics. There is an interplay with the Data Protection Act and probably the Human Rights Act which may be more complex than those directing its drafting expected or understood.
